  1. The lawyers little word game is based on the misuse of the word
  2. "shall" in the original statute.  Shall is imperative.  Where
  3. feasible, the Secretary must use sampling.  The intention of
  4. the legislature is clear.  They wanted to ensure that
  5. congressional apportionment would not be subject to sampling
  6. errors or fraudulent manipulation, so they intended that all
  7. heads be counted.  They tried to include two ideas in this
  8. section: a mandate for sampling feasible and the exclusion of
  9. apportionment from that mandate.  Generally, what is excluded
  10. from a mandate is not subject to the mandate.
